Prominent gun rights advocate John Snyder warns that the Obama administration, well aware of the unlikelihood of congressional complicity in Obama’s agenda of banning so-called “assault weapons” and “high capacity” magazines, might simply bypass Congress in pursuit of that sick, criminal agenda. An anti-gun owner initiative considered in Washington could lead to massive civil disobedience and a severe domestic crisis,” gun law expert John M. Snyder said today.
“According to confidential information,” he continued, “forces linked with the administration suggest the government classify semiautomatic firearms and multiple capacity ammunition feeding devices as Title 2 National Firearms Act items under the Gun Control Act of 1968.
“Under this scenario, semiautomatics and high capacity magazines could be acquired only with great difficulty and at great expense by America’s estimated 100 million law-abiding firearms owners.”
In other words, Obama could simply order the Bureau of Alcohol, Tobacco, Firearms and Explosives (BATFE) to regulate semiautomatic firearms (whether the new regulatory regime would involve all semiautomatics, or “only” a subset of them arbitrarily designated “assault weapons,” is not clear) and 11-round and larger magazines in the same draconian manner as is applied to machine guns, short-barreled rifles and shotguns, suppressors (commonly, if inaccurately, referred to as “silencers”), cannons, grenades, etc.
If the Second Amendment did not exist, and there were thus no Constitutional protection of the fundamental human right of the individual to keep and bear arms, this would still be blatantly unconstitutional. If there were no Tenth Amendment, and thus no Constitutional prohibition against federal regulation of that which the Constitution does not explicitly empower the federal government to regulate, this would still be blatantly unconstitutional. The Constitution’s mandated separation of powers is by itself enough to deny this scheme any pretense of legitimacy.
St. Louis Gun Rights Examiner is in no place to evaluate the quality of Mr. Snyder’s confidential sources, and admittedly, this rumor brings with it more questions than answers. What, for example, would be done about all the semiautomatics (and “high capacity” magazines) already in circulation (with the vast majority, thankfully, not registered or traceable)? How would the BATFE, already well beyond its competence in maintaining an accurate registry of machine guns, ever manage the vastly larger job of registering and monitoring the tens of millions of newly restricted guns and magazines?
Still, though, Obama’s hostility to an armed American citizenry is well documented, as is his willingness to bypass Congress when that darned Constitution and its inconvenient separation of powers get in the way.
What he needs to realize is that this move, if he makes it, would start a war. It is not a war he would win.
